1. Subject to the following terms & conditions the properties comprising of Four Gîtes at Préniac, St Pantaleon 46800 France, are available for holiday rental by prospective tenants (“the Client”) from Liz & Bill Moore (“the Owners”). 2. To reserve one of the Gîtes, the client should complete and sign the booking form and return it together with payment of the initial non-refundable deposit (25% of the total rental). Following receipt of the booking form and deposit the Owners will send a confirmation invoice and statement. This will be our formal acceptance of the booking.
3. The balance of the rent, together with the security deposit (see below) is payable not less than 8 weeks before the start of the rental period. If payment is not received by the due date, the Owners reserve the right to give notice in writing that the reservation is cancelled. The client will remain liable to pay the rent unless the owner is able to re-let the property. In this event clause 5 of the booking conditions will apply.
4. A security deposit of £100 (€140) is required in case of, for example, damage to the Gîte or its contents. However the sum reserved shall not limit the Client’s liability to the Owners, in the event that the cost of replacement or repair in respect of damage occasioned exceeds £100. The owners will account to the Client for the security deposit and refund the balance due within two weeks of the end of the rental period, providing nothing is damaged the cheque will be returned within a week after departure.
5. Subject to clauses 2 & 3 above, in the event of a non-insurable cancellation, refunds of amount paid will be made if the Owners are able to re-let the Gîte and any expenses or losses incurred doing so will be deducted from the refundable amount. T he Client is strongly recommended to arrange a comprehensive travel insurance policy (including cancellation cover) and to have full cover for the party’s personal belongings, since these are not covered by the Owner’s insurance.
6. The rental period shall commence at 4pm on the first day and finish at 10am on the last day. The owners shall not be obliged to offer the accommodation before the time stated and the Client shall not be entitled to remain in occupation after the time stated. 7. The maximum number of persons to reside in the Gîte shall be agreed at the time of booking and will be confirmed on the confirmation form. Any change to the number of persons MUST be agreed with Owners prior to the commencement of the rental period.
8. The Client agrees to be a considerate tenant and to take care of the Gîte and to leave it in a clean and tidy condition at the end of the rental period. The Owners reserve the right to make retention from the security deposit to cover additional cleaning costs if the Client leaves the Gîte in an unacceptable condition. The client also agrees not to act in any way, which would cause a disturbance to those residents in neighbouring Gîtes.
9. The Client shall report to the Owners without delay any defects in the Gîtes or breakdown in equipment or appliances in the Gîtes, garden, or swimming pool and arrange for the repair and/or replacement will be made as soon as possible.
10. The Owners shall not be liable to the Client:
- For any temporary defect or stoppage in the supply of the public services to the Gîtes, nor respect of any equipment or appliances in the Gîtes, garden and swimming pool.
- For any loss, damage or injury which is the result of adverse weather conditions, riot, war, strikes, or other matters beyond the control of the Owners.
- For any loss, damage, or inconvenience caused or suffered by the Client if the Gîtes shall be destroyed or substantially damaged before the start of the rental period and in any such event, the Owners shall within 7 days of notification to the Client, refund to the Client all sums previously paid in respect of the rental period.
11. The use of the accommodation and amenities such as the swimming pool, barbecues or parkland is entirely at the Client’s risk and no responsibility can be accepted by the Owners for any injury or loss or damage to the Client or his/her visitors or their belongings.
12. No glasses are permitted by the poolside. Please use the plastic ones provided in each Gîte for this purpose.
13. The swimming pool is unsupervised. Children must be supervised when using the swimming pool at all times. The Owners reserve the right to ask unsupervised children to leave the pool area at any time.
14. Please remember this is a rural area and the Owners cannot be held responsible for any indigenous animals or insects that may be present.
15. Under no circumstances shall the Owners’ liability to the Client exceed the amount paid to the Owners for the rental period.
16. The facts contained within the Gîtes description are, to the best of the Owners’ knowledge be they false or misleading, but the Owners cannot accept responsibility for errors contained therein or the results thereof.
